Welcome to Grow Brand Agency. These Terms and Conditions govern your use of our website and services. By accessing or using our services, you agree to be bound by these terms.

2. Services

Grow Brand Agency provides digital marketing, WhatsApp marketing, SEO/SMO, lead generation, and related services. Service specifications, deliverables, and timelines will be outlined in individual service agreements.

We reserve the right to modify, suspend, or discontinue any service at any time with prior notice to active clients.

3. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information necessary for service delivery
  • Respond to requests for information or approvals in a timely manner
  • Ensure all content provided complies with applicable laws and regulations
  • Grant necessary permissions and access for service implementation
  • Not use our services for illegal or unethical purposes

4. Payment Terms

Grow Brand Agency operates on a transparent and professional payment structure:

  • Payment Schedule: Payment terms are specified in individual service agreements. Typically, we require an advance payment before project commencement.
  • Accepted Payment Methods: We accept payments via:
    • Bank Transfer (NEFT/RTGS/IMPS)
    • UPI (Google Pay, PhonePe, Paytm, etc.)
    • Credit/Debit Cards
    • PayPal (for international clients)
  • Invoicing: Invoices are issued at project milestones or on a monthly basis for ongoing services. All invoices are due within 7 days of issuance unless otherwise agreed.
  • Late Payments: Payments not received within the specified timeframe may result in a late fee of 2% per month or temporary suspension of services until payment is cleared.
  • Price Changes: Service prices are subject to change with 30 days' prior written notice. Existing contracts will honor the agreed pricing for their duration.
  • Taxes: All quoted prices are exclusive of applicable taxes (GST, etc.) unless explicitly stated otherwise. Clients are responsible for any applicable taxes.

5. Refund and Cancellation Policy

We strive for client satisfaction, but please review our refund policy carefully:

Refund Eligibility

  • Service Not Delivered: Full refund available if we fail to commence services within the agreed timeframe without valid reason.
  • Material Breach: Partial or full refund may be considered if we materially breach the service agreement and fail to remedy within a reasonable time.
  • Non-Refundable Items: Setup fees, domain/hosting costs, third-party service fees, advertising spend, and completed work are non-refundable.

Cancellation Terms

  • Client Cancellation: Clients may cancel services with 15 days' written notice. Payment is required for all work completed up to the cancellation date.
  • Project-Based Services: Once project work has commenced, advance payments are non-refundable. Clients will receive all completed deliverables.
  • Monthly Retainers: Cancellation must be submitted before the next billing cycle. No refunds for the current month's services.
  • Company Cancellation: We reserve the right to cancel services with 30 days' notice, with a full refund of any advance payment for services not yet rendered.

Refund Process

Refund requests must be submitted in writing to info.growbrand@gmail.com. Approved refunds will be processed within 10-15 business days to the original payment method. We will acknowledge all refund requests within 3 business days.

Dispute Resolution

If you're unsatisfied with our services, please contact us first. We are committed to resolving any concerns professionally. Most issues can be resolved through open communication before considering refunds or cancellations.

6. Intellectual Property

All marketing materials, strategies, and creative works developed byGrow Brand Agency remain our intellectual property until full payment is received. Upon full payment, clients receive appropriate usage rights as specified in the service agreement.

Clients retain ownership of their brand assets, logos, and content provided to us for service delivery.

7. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of the business relationship. This obligation continues even after termination of services.

8. Results and Guarantees

While we strive for excellence, digital marketing results depend on various factors beyond our control. We do not guarantee specific results, rankings, or revenue outcomes unless explicitly stated in writing.

We commit to applying industry best practices and professional expertise to all client projects.

9. Limitation of Liability

Grow Brand Agency shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid by the client for the specific service in question.

10. Termination

Either party may terminate services with written notice as specified in the service agreement. Clients remain responsible for payment of services rendered up to the termination date.

We reserve the right to immediately terminate services if clients violate these terms or engage in unethical practices.

11. Third-Party Services

Our services may integrate with third-party platforms (WhatsApp, social media, analytics tools, etc.). We are not responsible for changes, disruptions, or issues arising from these third-party services.

12. Data Protection and Privacy

We collect and process personal data in accordance with applicable privacy laws. Client data will be used solely for service delivery and will not be shared with third parties except as necessary for service provision or as required by law.

13. Modifications to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Chandausi, Uttar Pradesh.
